Scope These general terms and conditions (“Terms and Conditions – Online Shop”) encompass all legal transactions conducted through the online shop www.Kicksity.com, hereinafter referred to as the “Online Shop.” Kicksity reserves the right to modify these terms and conditions at any time, with the version in effect at the time of ordering being decisive.

Offer The products and prices displayed in the Online Shop constitute an offer. This offer remains valid as long as the product is available and accessible on the website.

Products and Prices As our products are not originals, we offer them at significantly reduced prices compared to their retail counterparts. By making a purchase, the buyer acknowledges that the products are not sourced directly from the original manufacturer, and minor deviations may occur. Kicksity.com has the autonomy to set and revise prices as deemed necessary. The price published on the website at the time of ordering is the determining price. In cases where prices are mistakenly published, Kicksity.com reserves the right to contact the buyer before shipping to either rectify the price or cancel the order.

Prices are stated in CHF by default, and exchange rates are calculated automatically. Shipping and packaging costs are calculated and displayed separately from the product price. Any additional fees incurred by the chosen logistics partner will be the sole responsibility of the customer.

Information Provided Kicksity.com makes every effort to keep the information provided on the Online Shop accurate and up-to-date. However, due to potential production or delivery delays and sales through other channels, there may be variations in availability and delivery times. Therefore, all details regarding availability and delivery times are subject to change and come without a guarantee.

Kicksity.com assumes no liability for the accuracy or timeliness of information provided by other manufacturers, even if it has been meticulously researched.

Conclusion of Contract The purchase contract is established when the order is submitted online and accepted by Kicksity.com. To validate a purchase contract, it is essential to fully and truthfully complete the online order form and accept the general terms and conditions (“AGB – Online Shop”).

Kicksity.com acknowledges receipt of the order through an automatically generated email order confirmation. This confirmation signifies that the order has been received and that the purchase contract is contingent upon the possibility of delivery and the correct price.

Terms of Delivery and Collection

6.1 Availability and Delivery Products marked as “available” are typically delivered within 11 to 25 working days from the date of the order. If a product is out of stock or incorrectly marked as “available,” the customer will be promptly notified via email or phone, and a new provisional delivery date will be agreed upon. Kicksity.com strives for prompt delivery and will ship back-ordered items without additional shipping costs.

If a product becomes permanently unavailable and cannot be sourced or manufactured by Kicksity.com, the company may choose to withdraw from the contract while fully refunding the customer for the affected product.

In the event that Kicksity.com is unable to provide or ship the items within 60 calendar days from the date of the order, the customer retains the right to withdraw from the contract. Any payments made by the customer for the affected product will be fully reimbursed, with no further claims against Kicksity.com.

Should additional shipping costs arise due to an incorrect delivery address or inaccurate address information, these costs will be the sole responsibility of the buyer. Unless otherwise arranged, Kicksity.com ships orders both nationally and internationally.

6.2 Additional Provisions for Delivery If the customer fails to accept goods delivered by the supplier within the agreed-upon or specified delivery times, Kicksity.com may opt to withdraw from the contract, cancel the order, and charge the customer a processing fee of 15%, with a minimum invoice of CHF 30.

Obligation to Inspect Upon receiving or picking up products, the buyer must immediately inspect them for completeness, accuracy, and any delivery damage. In the case of a defect, the buyer must notify Kicksity.com within 7 calendar days, and the product must be returned in its original condition.

Guarantee Conditions and Services Kicksity.com sells items from various manufacturers and has no control over the durability, functionality, or warranty policies of these products. Therefore, the warranty information provided by the manufacturers applies, if applicable in Switzerland.

In addition, Swiss statutory warranty provisions as per Art. 197 ff. OR apply. To assert a warranty claim, the customer must present the purchase contract, including a valid order form.

No warranty claims can be made for damage resulting from improper handling or defects attributable to external factors. Such damage may include elemental damage, moisture damage, falls, impacts, or damage caused by modifications.

Kicksity.com may fulfill warranty claims by replacing the product with new items.

Liability and Disclaimer Kicksity.com is solely liable for the warranty services outlined in section 8. Any other liability, particularly for damages unrelated to the products themselves, is excluded. This includes indirect and consequential damages, such as lost profits, unrealized savings, or damages resulting from delivery delays. Additionally, Kicksity.com bears no responsibility for damage resulting from improper storage, incorrect size selection, or misuse of the product.

Payment 

The invoice for purchased goods must be paid in the currency specified therein and promptly upon or after the order is placed. The following payment methods are accepted in the online shop: credit cards through the Stripe payment platform (Mastercard, Visa), or Twint.
